Distance Contract
1. Contracting Parties This contract is concluded between: Seller: ELECTRONIFY OÜ, registration number 16889056, legal address: Harju maakond, Tallinn, Kesklinna linnaosa, Veskiposti tn 2-1002, 10138, email: [email protected], phone: +371 28699990. Buyer: Any natural or legal person who makes a purchase in the online store www.ele.lv, hereinafter referred to as the "Buyer."
2. Subject of the Contract This contract defines the rights and obligations of the Seller and the Buyer, the procedures for purchasing and delivering goods, as well as the terms for returning goods and warranty service.
3. Conclusion of the Distance Contract The contract between the Buyer and the Seller comes into effect when the Buyer has placed an order in the online store and received confirmation from the Seller regarding the acceptance of the order. The Seller’s confirmation is sent to the email address provided by the Buyer.
4. Price of Goods and Payment
4.1. The prices of goods are indicated including value-added tax (VAT).
4.2. The Buyer can pay for the goods using the payment methods offered in the online store (bank transfer, bank card, etc.).
5. Delivery and Delivery Terms
5.1. Goods are delivered to the address specified by the Buyer within 7 business days after receiving payment.
5.2. The Seller guarantees the delivery of goods within the specified time but is not responsible for delays caused by force majeure circumstances.
6. Right to Withdraw from the Contract and Return of Goods
6.1. The Buyer has the right to withdraw from the distance contract within 14 days from the moment of delivery, without providing a reason.
6.2. In case of returning goods, the Buyer must cover the direct costs of returning the goods, unless the Seller has agreed to cover these costs.
6.3. The Buyer must return the goods to the Seller within 7 days after sending the withdrawal notice.
6.4. The withdrawal notice must be sent in free form to the company's email [email protected] or using the contact form available on the website www.ele.lv, under the Contact section. The notice must include the purchase document number and date.
6.5. The Buyer cannot exercise the right of withdrawal if:
- The ordered goods, by their nature, cannot be returned, or are perishable or quickly consumable;
- The ordered goods have been custom-made specifically for the Buyer;
- The Buyer has opened digital products;
- The packaging of goods, which cannot be returned due to health and hygiene reasons, has been opened by the Buyer. 6.6. According to Section 12, Paragraph 6 of the Consumer Rights Protection Law of the Republic of Latvia, "the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period." The Seller reserves the right to refuse the Buyer from exercising the right of withdrawal or to withhold a compensation fee in case the product is damaged, mishandled, instructions are not followed, or the original packaging is lost or significantly damaged.
7. Warranty and Responsibility for Product Quality
7.1. The Seller guarantees that all goods are of high quality and comply with all regulations of the Republic of Latvia.
7.2. The warranty period is 2 (two) years from the date of delivery.
8. Dispute Resolution and Final Provisions
8.1. All disputes arising from this contract will be resolved through negotiations between the Parties. If a dispute cannot be resolved through negotiations, it will be settled according to the legislation of the Republic of Latvia .
8.2. This contract is drawn up and interpreted in accordance with the laws of the Republic of Latvia.
